About This Lesson
This lesson (which might take two days) has students analyze the four clauses of the Constitution that lawyers and judges have been citing as evidence of the unconstitutionality of Trump's Executive Order - the establishment, free exercise, due process, and equal protections clauses. Students read statements made by Trump during the campaign and after signing the executive order to establish what the intent of the Order may have been and then read the actual text of the executive order. Their goal in reading both is to find any evidence for or against violations of those four clauses from the Constitution.
Biased...only one view is presented which is written by David Cole (ACLU). Why not an excerpt from Chief Justice Roberts from his issued opinion, or Justice Thomas with his concurring opinion? There is no clarification that "Muslim Ban," which does not appear in Executive Order 13769, is not evidence but an interpretation. It appears that the line of questioning, in this assignment, is prejudicial and designed to produced a specific response as opposed to an individual student inquiry discovery.
